1. DISPOSIZIONI GENERALI

Le presenti Condizioni Generali di Vendita e Noleggio (di seguito “Condizioni Generali”) regolano l’accesso e l’utilizzo del sito web www.degasperibooking.it (di seguito “Sito”), di proprietà della società DEGASPERI NOLEGGIO SCI E BIKE SNC DI DEGASPERI LUIGI E STEFANO, con sede legale in Via dei Palustei, 7/A, 38121 – Meano (TN), P.IVA: 02509850224, iscritta al Registro delle Imprese di Trento.

L’utilizzo del Sito implica l’accettazione integrale delle presenti Condizioni Generali. Degasperi Rent si riserva il diritto di modificarle in qualsiasi momento. Le Condizioni Generali applicabili sono quelle in vigore al momento della conferma dell’ordine.

2. SERVIZI OFFERTI

Il Sito permette agli utenti di:

• Noleggiare biciclette e attrezzatura da sci con prenotazione online.
• Acquistare prodotti stagionali a prezzi scontati, spesso in promozione.

3. CONCLUSIONE DEL CONTRATTO

Le informazioni disponibili sul Sito costituiscono un invito a formulare una proposta contrattuale. L’invio di un ordine da parte del Cliente rappresenta una proposta d’acquisto o di noleggio. La conferma d’ordine trasmessa via email da Degasperi Rent costituisce accettazione della proposta e conclude il contratto.

4. PREZZI E MODALITÀ DI PAGAMENTO

• Tutti i prezzi sono espressi in Euro e includono l’IVA ove applicabile.
• Il pagamento può essere effettuato tramite carta di credito, bonifico bancario, PayPal o altri metodi indicati sul Sito.
• Degasperi Rent si riserva il diritto di modificare i prezzi in qualsiasi momento, ma gli ordini già confermati non subiranno variazioni.

5. SPEDIZIONE, CONSEGNA E RITIRO

• I prodotti acquistati vengono consegnati nei paesi disponibili sul Sito tramite corrieri selezionati.
• I costi di spedizione sono a carico del Cliente e specificati al momento dell’ordine.
• Per il noleggio, il ritiro e la riconsegna devono avvenire presso il punto indicato al momento della prenotazione.

6. DIRITTO DI RECESSO (SOLO PER ACQUISTI, NON NOLEGGIO)

Conformemente al Codice del Consumo (D.Lgs. 206/2005):

• Il Cliente ha diritto di recedere dall’acquisto entro 14 giorni dal ricevimento del prodotto, senza necessità di fornire motivazioni.
• Per esercitare il recesso, il Cliente deve inviare una comunicazione scritta via email a info@degasperirent.it.
• Il reso è a carico del Cliente e i prodotti devono essere restituiti integri e nella confezione originale.
• Degasperi Rent effettuerà il rimborso entro 14 giorni dal ricevimento della merce restituita.
• Per il noleggio, il diritto di recesso non si applica (art. 59 Codice del Consumo).

7. GARANZIA LEGALE E RECLAMI

• I prodotti venduti sono coperti da una garanzia legale di conformità di 24 mesi per i consumatori.
• Per segnalare un difetto o presentare un reclamo, il Cliente deve contattare il servizio clienti all’indirizzo email info@degasperirent.it.

8. RESPONSABILITÀ

• Degasperi Rent non sarà responsabile per ritardi o inadempimenti dovuti a cause di forza maggiore.
• Il Cliente è responsabile dell’uso corretto dei prodotti e del rispetto delle condizioni del noleggio.
• Per il noleggio di biciclette e attrezzature sportive, il Cliente è responsabile della loro manutenzione e utilizzo corretto.

9. PROTEZIONE DEI DATI PERSONALI

Degasperi Rent tratta i dati personali dei Clienti conformemente al Regolamento (UE) 2016/679 (GDPR). Maggiori dettagli sono disponibili nella  Privacy Policy.

10. PROPRIETÀ INTELLETTUALE

• Tutti i contenuti del Sito (testi, immagini, loghi, grafiche) sono di proprietà di Degasperi Rent e non possono essere riprodotti o utilizzati senza autorizzazione.

11. LEGGE APPLICABILE E FORO COMPETENTE

Le presenti Condizioni Generali sono regolate dalla legge italiana. Per qualsiasi controversia sarà competente in via esclusiva il Foro di Trento.

1. GENERAL PROVISIONS

These General Terms and Conditions of Sale and Rental (hereinafter “General Terms and Conditions”) govern access to and use of the website www.degasperibooking.it (hereinafter “Website”), owned by the company DEGASPERI NOLEGGIO SCI E BIKE SNC DI DEGASPERI LUIGI E STEFANO, with registered office at Via dei Palustei, 7/A, 38121 – Meano (TN), VAT No: 02509850224, registered with the Trento Business Register.

Use of the Website implies full acceptance of these General Terms and Conditions. Degasperi Rent reserves the right to modify them at any time. The applicable General Terms and Conditions are those in effect at the time of order confirmation.

2. SERVICES OFFERED

The Website allows users to:

• Rent bicycles and ski equipment with online reservations.
• Purchase seasonal products at discounted prices, often on promotion.

3. CONTRACT FORMATION

The information available on the Website constitutes an invitation to submit a contractual proposal. The Customer’s order submission represents a purchase or rental proposal. The order confirmation sent by Degasperi Rent via email constitutes acceptance of the proposal and finalizes the contract.

4. PRICES AND PAYMENT METHODS

• All prices are expressed in Euros and include VAT where applicable.

• Degasperi Rent reserves the right to modify prices at any time, but confirmed orders will not be subject to changes.

5. SHIPPING, DELIVERY, AND PICK-UP

• For rentals, pick-up and return must take place at the location specified at the time of booking.

6. RIGHT OF WITHDRAWAL (PURCHASES ONLY, NOT RENTALS)

In accordance with the Consumer Code (Legislative Decree 206/2005):

• The Customer has the right to withdraw from the purchase within 14 days of receiving the product, without providing a reason.
• To exercise the right of withdrawal, the Customer must send a written request via email to info@degasperirent.it.
• Return shipping costs are borne by the Customer, and products must be returned intact and in their original packaging.
• Degasperi Rent will process the refund within 14 days of receiving the returned goods.
• The right of withdrawal does not apply to rental services (Article 59 of the Consumer Code).

7. LEGAL WARRANTY AND COMPLAINTS

• Sold products are covered by a 24-month legal warranty of conformity for consumers.
• To report a defect or file a complaint, the Customer must contact customer service at info@degasperirent.it.

8. LIABILITY

• Degasperi Rent is not responsible for delays or non-fulfillment due to force majeure.
• The Customer is responsible for the proper use of products and compliance with rental conditions.
• For bicycle and sports equipment rentals, the Customer is responsible for their proper maintenance and use.

9. PERSONAL DATA PROTECTION

10. INTELLECTUAL PROPERTY

• All content on the Website (texts, images, logos, graphics) is the property of Degasperi Rent and may not be reproduced or used without authorization.

11. APPLICABLE LAW AND JURISDICTION

These General Terms and Conditions are governed by Italian law. Any dispute will be exclusively subject to the jurisdiction of the Court of Trento.
